Complex Financial Matters in Perth Family Law

A specific process is usually followed for the Family Court of Western Australia to make Orders for an alteration of property interests and subsequently to terminate the financial relationship.

The financial relationship is not usually terminated until you receive Orders from the Family Court of Western Australia.

That is, all assets and liabilities would broadly be treated as assets and liabilities of the marriage or relationship until you receive Orders.

Mediation may be required to reach an agreement on the Orders. If an agreement is reached a Form 11 can be filed in the Family Court.

Agreeing on values in the asset pool and working towards a resolution as to how to share those assets either in mediation or in Court if necessary is important. Parties can then agree on their respective contributions to the asset pool and their future needs. Parties can then agree on a percentage that would fall within the range of what is just and equitable.

As such, even in complex financial matters, we assist parties in reaching an agreement as to how the assets and liabilities of the marriage or relationship can be shared in a just and equitable manner.
