In Perth, Western Australia, child support will usually end when the child turns 18. If the child is still living at home however, maintenance expenses will likely still exist.
Adult child maintenance is child support for children past the age of 18, granted to help cover expenses in certain circumstances.
The Family Law Act (Cth) 1975 provides that situations where further financial support is necessary may include:
- To enable the child to complete his or her education; or
- Because of the child’s mental or physical disability.
If an agreement cannot be reached between the adult child and the parents, negotiations may need to take place between the respective legal representatives through mediation or otherwise.
As this can be a complex process, we recommend you seek legal advice from one of our experienced family law solicitors. We invite you to discuss your particular situation with our Legal Practitioner Director, Ms. Shannon Bodeker, who specialises in mediation.
